Court Decision on the Nold Case Regarding the Protection of Fundamental Rights

According to the Court’s decision on Case 4/73, Nold, the sources of law used in the context of protecting fundamental rights are derived not only from the constitutions and constitutional traditions of the member states but also from international treaties on human rights protection which the member states have accepted. Restrictions on rights (and in this particular case, the right to property and freedom to pursue a trade or profession) are subject to limitations if and to the extent that they justify general objectives set by the Community.
