Court Decision on the Principle of Proportionality

The Court, in its decision regarding Case C-189/01, H. Jippes and Others, emphasizes that the principle of proportionality, which is also one of the general principles of Community law, must be applied within the framework of what is necessary and appropriate for achieving the legitimate objective pursued. Consequently, the measures of the Community institutions must not exceed these limits. Where there is a choice of measures, the most favorable measure should be selected, and the resulting disadvantages should not be disproportionate to the intended purpose.
