Court Decision Referring to the Right of Action for Annulment

The Court, in its decision in Case 60/81, states that “According to the Court’s established case-law, any measure whose legal effects are binding on the applicant and capable of affecting their interests by clearly altering their legal position, constitutes an act or decision which may be the subject of an action for annulment within the meaning of Article 173 (now 230 of the Treaty establishing the European Community)”.
