Double Ruling by the European Court

The Court issues a ruling on Cases C-46/93 and C-48/93, Brasserie du pêcheur and Factortame, which were heard together. According to the Court’s findings, in the event of a breach of Community law by a Member State due to the fault of the national legislator, the existence of individuals who have suffered damage raises claims for compensation, provided that the Community rule violated confers specific rights, the violation is particularly serious, and there is a direct causal link between the violation and the damage.
