Pivotal Decision by the European Court Regarding Community Law

A judicial decision is issued by the European Court for Case 152/84, Marshall/Southampton and South-West Hampshire Area Health Authority. According to the Court’s decision, an individual can invoke an EU Directive and engage in a legal dispute with the state, regardless of their status (employer or public authority). In all cases, the state must comply with Community law.
